Packaging EPR in Czechia

A business placing packaging on the Czech market may need to join the Ministry list, keep packaging records, and meet take-back and recovery duties, commonly through EKO-KOM. The responsible entity and representative route depend on establishment and the sales model.

Seller established outside the EUAR is optional under the national rule

Under the current PPWR rule, an EU company selling packaged products directly to end users in Czechia must appoint an EPR authorised representative there. Czech law permits a non-established producer to appoint an AR; a separate mandatory third-country rule was not found. A pending EU proposal may suspend the EU cross-border rule, but it has not changed current law.

PPWR still requires annual packaging data below 10 tonnes; the dataset is simplified rather than exempt, and a Member State can set a lower simplification limit or require quarterly reporting. The current Czech exemption applies only while annual packaging is no more than 300 kg and turnover is no more than CZK 25 million. Its transition against PPWR Article 44 still needs authority confirmation.

Transition to verify

PPWR has applied since 12 August 2026. Its current Article 45(3) requires an EU-established producer selling directly to end users in another Member State to appoint an EPR authorised representative there. A Commission proposal to suspend that rule is still an ongoing legislative procedure and has not changed the law.[EU][2][3]

For cross-border direct sales by an EU-established producer, the current PPWR requires an EPR authorised representative in Czechia. Czech law also lets a person not established in Czechia appoint a representative and specifically requires one for certain distance-sold single-use plastic packaging. Confirm which rule and registration route apply to the seller.[EU][2]
